These Terms of Service (“Terms”) form an agreement between you and Infinite Home Comfort when you use our website, request an appointment, review or approve a quote, make a payment, or otherwise use our online services. If a signed quote or written service agreement conflicts with these Terms, that document governs the applicable job.
1. Acceptance and eligibility
By using the website or submitting an online request, you agree to these Terms and our Privacy Policy. You must be at least the age of majority in your province or territory and have authority to request work at the property. If you act for an organization or property owner, you confirm you are authorized to bind them.
If you do not agree, do not use the online tools. You may still contact us by phone to discuss available service options.
2. Website information and availability
We aim to keep website descriptions, availability, pricing examples, promotions and product information accurate. Website content is general information and may change without notice. Product images may be illustrative, and specifications, inventory, rebates, utility programs and appointment times remain subject to confirmation.
We may update, suspend or discontinue website functions for maintenance, security or operational reasons. We do not promise uninterrupted or error-free access.
3. Bookings and appointments
An online submission is an appointment request until you receive confirmation from us. Available windows are based on current schedules, service areas, job duration and travel estimates. Assignment to a particular advisor, technician or installer is not guaranteed and may change.
- Arrival times are estimates and may be affected by traffic, weather, emergencies or an earlier job.
- You must provide accurate contact, address, service and access information.
- Rescheduling or cancellation is available through your management link or by contacting us. Job-specific cancellation charges, if any, will be disclosed in the accepted quote or agreement and are subject to applicable law.
- For urgent conditions involving fire, gas, carbon monoxide or immediate danger, leave the area and contact the appropriate emergency service or utility; do not rely on an online booking request.
4. Quotes, estimates and scope of work
A quote identifies the proposed equipment, work, pricing, discounts, taxes, payment terms and validity period. A quote is not accepted until the required approval, signature or other confirmation has been recorded. Where multiple options are shown, only the selected items form part of the accepted work.
Changes may be required if site conditions differ from the information available when the quote was prepared, including concealed damage, code requirements, electrical or structural limitations, inaccessible equipment, hazardous materials or customer-requested additions. We will seek approval for a material change before proceeding unless immediate action is reasonably required for safety.
Rebates, grants, utility incentives and manufacturer programs are administered by third parties unless the quote expressly says otherwise. Eligibility and payment are not guaranteed by Infinite Home Comfort.
5. Deposits, invoices and payments
Deposits, progress payments, final balances, accepted payment methods and due dates are set out in the applicable quote or invoice. Where partial card payments are offered, each payment reduces the outstanding balance but does not change the total amount due.
- Card payments may be processed by Stripe or another disclosed payment processor under that provider’s terms.
- You authorize us and the payment provider to process the amount you approve and to record its status in the customer account.
- Taxes are added where required. Fees or financing charges will be disclosed before approval where applicable.
- Refunds, cancellations and discounts require authorization and are handled according to the written quote, applicable warranty, payment-provider rules and applicable law.
If you believe a payment is incorrect, contact us promptly so we can investigate before initiating a chargeback. Nothing in these Terms limits a right you have under consumer protection law.
6. Financing
Financing is offered by independent lenders or brokers, including Abode Financial where displayed, and is subject to credit approval (“OAC”). An application does not guarantee approval, a particular rate, payment amount or term. The lender’s disclosure and agreement govern the financing relationship.
Monthly payment examples are estimates based on stated assumptions and may exclude taxes, fees or optional items. Review the lender’s final terms before accepting. Infinite Home Comfort does not make the lender’s credit decision and is not responsible for its platform or underwriting.
7. Customer responsibilities
You agree to:
- provide accurate, complete information and promptly correct material errors;
- ensure an adult with authority is present when reasonably required;
- provide safe, reasonable access to the property, equipment, utilities and work areas;
- disclose known hazards, pets, access restrictions, existing damage and relevant equipment history;
- follow operating, maintenance, safety and warranty instructions provided to you; and
- obtain owner, condominium or other approvals assigned to you in the written scope.
We may pause or refuse work where conditions are unsafe, unlawful or materially different from the agreed scope.
8. Electronic communications
You agree that we may send service-related texts and emails to the contact details you provide, including confirmations, reminders, arrival notices, quote links, signatures, invoices, installation scheduling and account support. Standard carrier charges may apply.
Marketing communications are handled according to consent and applicable law. Use the unsubscribe link in a marketing email or reply STOP to a marketing text to opt out. Transactional messages needed for an active request or service may continue.
Calls may be recorded, transcribed or summarized for quality, training, documentation and follow-up where notice or consent is required. Our handling of personal information is described in the Privacy Policy.
9. Warranties and service limitations
Any workmanship warranty, maintenance coverage or satisfaction commitment will be stated in the applicable written agreement. Equipment is also subject to the manufacturer’s warranty, registration requirements, exclusions and remedies. Manufacturer warranty decisions are made under the manufacturer’s terms.
Except for an express written warranty and rights that cannot legally be excluded, website materials and online tools are provided on an “as available” basis. No oral statement changes a written warranty or scope unless confirmed by an authorized representative in writing.
10. Acceptable use
You may not misuse the website or customer links, attempt unauthorized access, interfere with security, submit false or unlawful information, copy or scrape content at scale, impersonate another person, or use our systems to distribute harmful code or unsolicited messages. We may restrict access to protect customers, staff or systems.
11. Intellectual property
The website, brand elements, designs, text, graphics, software and original content are owned by or licensed to Infinite Home Comfort and protected by applicable intellectual-property laws. You may use the website for personal, non-commercial purposes connected with evaluating or receiving our services. No other rights are granted.
12. Third-party services and links
Our website may connect to independent services for maps, financing, payments, reviews, social media or other functions. Their availability, content and practices are controlled by those providers. Review their terms and privacy policies before using them.
13. Liability
To the maximum extent permitted by law, Infinite Home Comfort is not liable for indirect, incidental, special or consequential loss arising solely from use of, or inability to use, the website or a third-party platform. Job-specific responsibility is governed by the accepted quote or service agreement and applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or waives rights and remedies available under Ontario consumer protection or other applicable legislation.
14. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without limiting mandatory consumer rights that apply in your jurisdiction. The courts of Ontario will have jurisdiction, subject to any dispute process or venue required by law.
15. Changes to these Terms
We may update these Terms as our services or legal requirements change. The current version and effective date will remain posted here. Changes apply prospectively unless otherwise stated or required by law.
